Germany's Skilled Immigration Act: what it means for Africans who want to work here.

In November 2023, Germany passed the most significant overhaul of its immigration laws in two decades. The Fachkräfteeinwanderungsgesetz — the Skilled Immigration Act — fundamentally changed who can come to Germany, under what conditions, and with how much flexibility. Most Africans who would benefit from it have never heard of it.

This article explains what changed, who it affects, and why it matters for anyone in Africa who has been watching Germany from a distance and wondering whether there is a realistic path in.

What the old law looked like

Before 2023, Germany's immigration system for skilled workers from outside the EU was relatively restrictive. The basic rule was straightforward: you needed a recognised qualification in a regulated profession, a concrete job offer in Germany, and evidence that the employer had tried and failed to find a suitable EU candidate first. This last requirement — called the priority check (Vorrangprüfung) — was a significant barrier. Even if a German company wanted to hire you, the bureaucratic hurdle of proving no EU citizen could fill the role added months to the process and discouraged many employers from pursuing non-EU candidates at all.

The result was a system that worked reasonably well for highly specialised professionals in acute shortage areas — certain medical specialties, specific engineering fields — but was effectively closed to the broader pool of skilled, motivated, qualified Africans who had a great deal to offer but did not fit the narrow criteria.

What the 2023 reform changed

The new law introduced changes across four main areas. Together they represent a structural shift in Germany's posture toward skilled immigration from outside the EU.

Abolition of the priority check for most skilled workers. The requirement to prove that no EU candidate was available has been removed for most categories of skilled worker. German employers can now hire the best candidate for the job — regardless of nationality — without having to justify why they did not choose an EU citizen first. This single change removes one of the biggest administrative barriers that previously discouraged employers from pursuing non-EU candidates.

Expanded recognition of vocational qualifications. Previously, only formally recognised academic qualifications opened the door to work in Germany. The new law creates pathways for people with vocational qualifications — trade certificates, technical diplomas, professional licences — even when the German recognition process for those specific qualifications has not yet been completed. An employer who is convinced of your competence can now sponsor your entry while the formal recognition process runs in parallel, rather than you having to wait outside until everything is settled.

Recognition of practical experience. For certain categories of shortage occupations, the new law allows substantial professional work experience to substitute for formal qualification recognition. This is a significant opening for experienced professionals whose qualifications may not fit neatly into the German recognition system but whose demonstrated competence is exactly what German employers need.

The Opportunity Card — a new points-based visa. The reform introduced the Chancenkarte, a new visa category that allows qualified non-EU nationals to come to Germany to search for work — without having secured a job offer first. Which professions are most affected

Germany publishes an official shortage occupation list (Mangelberufsliste) which is updated regularly. The current list includes professions across healthcare, engineering, IT, construction and skilled trades, education, and logistics. These are areas where the new law's expanded pathways apply most generously — meaning faster processing times, greater flexibility in qualification recognition, and more employer willingness to sponsor non-EU candidates.

Healthcare is particularly notable. Germany has a documented shortage of nurses, care workers, doctors, and medical technicians that is expected to worsen significantly over the next decade as the population ages. African professionals in these fields — particularly from countries with established healthcare training systems such as Kenya, South Africa, Tanzania, Ghana, and Nigeria — are increasingly in demand and increasingly able to access Germany through the new legal pathways.

The 2023 reform does not mean Germany's doors are fully open with no requirements. You still need qualifications, you still need language ability, and you still need to navigate a system that is genuinely complex and bureaucratic. The Opportunity Card: Germany's new points-based visa and whether you might qualify.

In June 2024, Germany introduced the Chancenkarte — the Opportunity Card. It is a visa that allows qualified non-EU nationals to enter Germany and search for work for up to one year, without needing a job offer before they arrive. It is one of the most significant new tools available to skilled Africans considering Germany — and most people who would qualify for it have never heard of it.

What the Opportunity Card actually is

The Chancenkarte is not a work permit. It is a job-seeker visa with a points-based eligibility system. It allows you to enter Germany legally, live there for up to one year, and use that time to find employment, attend interviews, and build relationships with potential employers — all before you have a formal job offer in hand.

During this period you are permitted to work up to 20 hours per week in any field — regardless of your qualifications — to support yourself financially while you search for a position in your actual profession. Once you secure a qualifying job offer, you transition from the Opportunity Card to a standard work visa or residence permit. You do not have to leave Germany to do this transition in most cases.

This is a significant departure from the previous system, where most non-EU nationals had to secure a job offer from outside Germany, go through the full recognition process, obtain the work visa, and only then enter the country. The Opportunity Card reverses the sequence — you come first, then you find the job.

How the points system works

To qualify for the Opportunity Card you need to meet a base requirement and then accumulate enough points from a set of additional criteria. You need a minimum of six points to be eligible.

The base requirement is either a German university degree, a foreign degree that is formally recognised in Germany, or a foreign vocational qualification that has been recognised as equivalent to a German qualification. If you meet the base requirement you automatically qualify for the card regardless of points — you simply apply.

If your qualification is not yet formally recognised, you can still qualify through the points system. Points are awarded for: German language ability (2 points for B2, 1 point for A2 or B1), work experience in a shortage occupation (1 point for two or more years), age under 35 (1 point), a prior connection to Germany such as previous study, residence, or work (1 point), and English language ability at C1 level (1 point).

A concrete example: a 32-year-old nurse from Kenya with three years of professional experience, B1 German, and C1 English would score 1 point for age, 1 point for shortage occupation experience, 1 point for German, and 1 point for English — a total of 4 points without formal recognition, which falls short. But the same person with B2 German would score 2 points for language, reaching 5 points total — still one short. Adding any prior German connection — even a short language course in Germany — would bring them to 6 and qualify them. This is the kind of specific profile assessment that determines whether the Chancenkarte is accessible to a particular person.

What you can and cannot do on the Opportunity Card

You can live in Germany for up to one year. You can work up to 20 hours per week in any job. You can attend job interviews, professional events, and networking meetings. You can begin the formal recognition process for your qualification while in Germany, which is often faster and more straightforward than doing it from outside. You can transition directly to a work visa once you have a qualifying job offer, without leaving the country.

You cannot work full-time in your qualified profession until you have the appropriate work permit. You cannot bring dependants on the Opportunity Card itself — family reunification requires a longer-term residence status. The card cannot be extended beyond one year. If you do not find a qualifying position within the year, you must leave — though you may reapply in the future.

Which African countries are most positioned to benefit

The Opportunity Card is available to nationals of all non-EU countries. In practice, the countries whose professionals are most positioned to benefit are those with established higher education systems, English-language professional training, and professions that appear on Germany's shortage occupation list.

Kenya, South Africa, Tanzania, Ghana, and Nigeria produce large numbers of healthcare professionals, engineers, and IT specialists who are trained to internationally competitive standards. Francophone African countries — Cameroon, Senegal, Côte d'Ivoire — have strong vocational and academic training traditions in engineering, education, and administration. Professionals from all of these countries may find the Opportunity Card opens a door that previously required a job offer to unlock.

The Opportunity Card is a genuine opportunity — but it is not a free pass. You need qualifications, you need financial means to support yourself during the search period (Germany requires proof of approximately €1,000 per month in accessible funds), and you need a realistic plan for finding work within twelve months. Arriving in Germany without a professional network, without adequate German, and without a clear strategy is unlikely to result in success within the available window.

Why Germany needs Africa: the demographic reality behind the open doors.

The Triple Win Programme, run by GIZ (Deutsche Gesellschaft für Internationale Zusammenarbeit) on behalf of the German government, specifically recruits nursing professionals from the Philippines, Tunisia, Jordan, Bosnia-Herzegovina, and — increasingly — sub-Saharan Africa. The programme covers language training, recognition support, and integration assistance. It is a direct, government-funded pipeline for exactly the kind of healthcare professionals Germany most urgently needs.

The bilateral relationships to know about

Germany and Kenya signed a migration and mobility partnership in 2023 that explicitly covers labour migration pathways for skilled Kenyan workers. Germany and Nigeria have an ongoing development partnership through GIZ that includes skills development and mobility components. The German-South African partnership covers recognition of qualifications in healthcare and engineering. Cameroon has long-standing educational ties with Germany through DAAD — the German Academic Exchange Service — that support student and professional mobility.

These relationships matter because they create institutional infrastructure — agreements on qualification recognition, language training partnerships, embassy processing prioritisation — that makes the practical journey from Africa to Germany more navigable than it would otherwise be.
